Terms of Service
Effective October 5, 2026
These Terms of Service (“Terms”) are an agreement between you and Driveit, Inc., a Wyoming corporation (“DriveIt,” “we,” “us”). They apply when you use driveit.ai, the booking websites we host for car-rental businesses, and our related apps and services (together, the “Services”). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
1. About DriveIt and these terms
DriveIt provides software that car-rental businesses and independent hosts (“Operators”) use to list vehicles, take bookings, verify renters, accept payments and run their business. People who book vehicles are “Renters.” People an Operator invites to help, such as mechanics, are “Team Members.”
DriveIt is not a rental car company. We do not own, rent, insure, inspect or maintain the vehicles listed on the Services. Each rental is an agreement directly between the Renter and the Operator, under the Operator’s rental agreement and policies. The Operator is responsible for its vehicles, its rentals, its pricing and policies, and its compliance with the law.
2. Accounts
- You must be at least 18 years old and able to form a binding contract to create an account.
- Give accurate information and keep it up to date.
- Keep your sign-in details secure. You are responsible for activity on your account. Tell us right away at [email protected] if you believe your account has been used without permission.
- If you use the Services for a business, you confirm you are authorized to bind that business to these Terms.
3. Renting a vehicle
- Eligibility. You must hold a valid driver’s license and meet the Operator’s age, license, insurance and other requirements. Operators may require you to verify your identity, license and insurance, including a selfie and face comparison, before your trip.
- Rental agreement. When you book, you enter into a rental agreement with the Operator. Its terms, including cancellation, mileage, fuel, smoking, pet, late return and damage policies, are shown before you book and govern your rental. If those terms conflict with these Terms on a rental matter, the rental agreement controls between you and the Operator.
- Only approved drivers may drive the vehicle. You must follow traffic laws and the rental agreement, and return the vehicle on time, in the condition you received it apart from normal wear.
- Vehicle technology. Vehicles may have devices that record location, mileage, speed and other data, and that let the Operator lock or unlock the vehicle remotely. By renting, you acknowledge this.
- Insurance. Coverage depends on the Operator and on your own policy. DriveIt does not provide insurance. Check what coverage applies before your trip.
- Accidents and damage. Report accidents, damage, theft and mechanical problems to the Operator right away and follow local law.
4. Payments, deposits and charges
- Rental payments are made to the Operator and processed by Stripe. DriveIt does not hold your rental payment. Your payment is also subject to Stripe’s terms.
- The price, taxes, fees and any security deposit are shown before you book. Operators may place an authorization hold or take a security deposit and release it under their policies.
- You authorize the Operator to charge your payment method for amounts you owe under the rental agreement, such as extra mileage, fuel, cleaning, late returns, tolls, parking and traffic tickets, damage, and related fees, as allowed by law and the rental agreement.
- Cancellations and refunds follow the Operator’s cancellation policy shown at booking. Questions or disputes about a charge should go to the Operator first.
5. Operators
If you are an Operator, you agree that:
- You have the right to rent each vehicle you list, and each vehicle is legally registered, safe, roadworthy, properly maintained, and covered by the insurance the law and your rental terms require.
- Your listings, prices, fees and policies are accurate, and you honor the bookings you accept.
- You are responsible for your rental agreements, your dealings with Renters, refunds, deposits, claims, taxes, licenses and permits, and for complying with all laws that apply to your business, including consumer-protection, anti-discrimination, privacy and data-protection laws.
- You use Renter information only to provide and manage rentals and as the law allows, and you keep it secure.
- You only charge Renters amounts allowed by the rental agreement and the law, and you keep evidence to support them.
- You are responsible for your Team Members’ use of the Services, including remote lock and unlock commands they send.
- To accept payments, you must connect a Stripe account and accept Stripe’s terms. You are the seller of record for your rentals.
6. Operator subscriptions
- Some features require a paid subscription. Prices and plan features are shown when you subscribe.
- Subscriptions renew automatically each billing period until you cancel. You authorize us, through Stripe, to charge your payment method for each renewal.
- You can cancel at any time. Cancellation takes effect at the end of the current billing period. Fees already paid are not refundable, except where the law requires.
- We may change prices with at least 30 days’ notice. The new price applies from your next billing period after the notice.
- Fees do not include taxes, which you are responsible for.
7. Integrations and connected services
The Services can connect to services run by others, such as Stripe, Turo (through TuroVA), MooveTrax, Google, insurance providers and banks (through Stripe Financial Connections). When you connect one, you authorize us to access and use the data it provides as described in our Privacy Policy, and you remain bound by that service’s own terms. We do not control those services and are not responsible for their availability, accuracy or actions. You are responsible for following the terms of any platform you connect, including Turo. Remote vehicle commands depend on the device, its connection and the provider, and may not always work.
8. Your content
You keep ownership of the content you upload, such as photos, listings, documents, receipts and messages (“Your Content”). You give DriveIt a worldwide, non-exclusive, royalty-free license to host, copy, process, display and adapt Your Content as needed to run, improve and promote the Services. For Operators, this includes showing your listings on your booking site and in DriveIt search. You confirm you have the rights to Your Content and that it does not violate the law or anyone’s rights.
9. Acceptable use
You agree not to:
- Break the law, or use the Services for fraud, or rent or list vehicles you are not allowed to.
- Give false information, impersonate anyone, or use someone else’s identity, license or payment method.
- Harass, threaten or discriminate against anyone.
- Upload malware, or interfere with or disrupt the Services.
- Access the Services by automated means (such as scraping), or try to get around security or access controls, except through features we provide for that purpose.
- Copy, resell or reverse engineer the Services, except where the law allows.
- Use another person’s data from the Services for anything other than the rental it relates to.
10. AI features
Some features use artificial intelligence, for example to read documents and receipts, suggest categories and matches, or draft descriptions and website content. AI output can be wrong. Review it before relying on it, especially for identity, payments, taxes and legal matters. You are responsible for how you use it.
11. Privacy
Our Privacy Policy explains how we collect and use personal information, including identity verification, vehicle location data and linked bank accounts.
12. Disclaimers
The Services are provided “as is” and “as available.” To the fullest extent the law allows, DriveIt disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Services will be uninterrupted, secure or error-free. We do not make any promise about any vehicle, Operator or Renter, or about the results of identity, license or insurance checks.
13. Limitation of liability
To the fullest extent the law allows, DriveIt will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. DriveIt is not liable for any injury, death, property damage, accident, theft or loss arising from a rental or a vehicle, or from the acts of Operators, Renters, Team Members or third-party services. DriveIt’s total liability for any claim relating to the Services is limited to the greater of (a) the amounts you paid DriveIt in the 12 months before the claim and (b) US $100.
Some places do not allow some of these limits, so they may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
14. Indemnity
To the extent the law allows, you will defend and indemnify DriveIt and its officers, employees and agents against claims, losses and costs (including reasonable legal fees) arising from your use of the Services, Your Content, your rentals or vehicles, or your breach of these Terms or the law.
15. Suspension and termination
You can stop using the Services and close your account at any time. We may suspend or end your access if you break these Terms, create risk or legal exposure for DriveIt or others, or if we stop offering the Services. Where reasonable, we will tell you first. Sections that by their nature should survive termination, such as payment obligations, disclaimers, limitation of liability, indemnity and disputes, will survive.
16. Disputes and governing law
Disputes about a rental, including charges, deposits, damage and cancellations, are between the Renter and the Operator. We may help, but we are not required to resolve them.
For any dispute with DriveIt, please contact us first at [email protected] so we can try to resolve it informally. These Terms are governed by the laws of the State of Wyoming and applicable US federal law, without regard to conflict-of-law rules. Any dispute that is not resolved informally will be heard in the state or federal courts located in Wyoming, and you and DriveIt consent to their jurisdiction, except that either party may bring an individual claim in small-claims court where it qualifies, and except where the law of the place you live requires otherwise.
17. General
- Changes. We may update these Terms. If we make material changes, we will notify you by email or in the Services before they take effect. Continuing to use the Services after that means you accept the updated Terms.
- Entire agreement. These Terms, the Privacy Policy and any plan terms shown when you subscribe are the whole agreement between you and DriveIt about the Services.
- Severability. If part of these Terms cannot be enforced, the rest stays in effect.
- No waiver. If we do not enforce a right, we have not given it up.
- Assignment. You may not transfer these Terms without our consent. We may transfer them in connection with a merger, acquisition or sale of assets.
- Notices. We may send notices to the email address on your account or in the Services.
